Hawaii State Advertising Regulations
The state of Hawaii does not allow cannabis medical dispensaries to advertise.
Hawaii's cannabis advertising regulations, detailed in Section 11-850-145, impose stringent limitations on how dispensaries can promote their products. According to the policy, dispensaries are prohibited from engaging in any form of advertising through various media channels, including broadcast, electronic, and print media.
This restriction covers radio, television, the internet, social media, newspapers, magazines, billboards, and placards on public transit. The only exceptions are that dispensaries may use their websites or private messaging systems to provide general information upon request. This includes contact details, retail locations, and a list of available products with limited descriptions.
Dispensaries are restricted from displaying cannabis products in windows or any other public viewable areas. The use of terms like "candy" or "candies" is also banned in advertising, product lists, and menus to avoid appealing to a younger audience.
Additionally, dispensaries and their staff must refrain from making unsubstantiated health or benefit claims about their products. These measures are designed to ensure that cannabis advertising remains discreet and compliant with state regulations, aiming to prevent misleading information and maintain a professional standard in the marketing of cannabis products.
