Licensed cannabis businesses in New Jersey may advertise their products, but must ensure that at least 71.6% of the audience is 21 years or older. All advertisements must include a warning about cannabis use, disclose the business’s state licensing, and avoid targeting or appealing to individuals under 21. Specific restrictions are placed on the timing and location of ads, such as prohibiting them near schools, during certain hours on TV and radio, and in venues where a significant portion of the audience may be underage.
Advertisements must not suggest that cannabis is inherently safe, promote overconsumption, or make false or misleading claims. Additionally, cannabis businesses cannot use mascots, display cannabis products in a way that is visible from the outside, or advertise prices in public spaces, although they may list prices on their websites. External signage is limited to identifying the business name and must comply with local ordinances.
