Arizona State Advertising Regulations

Under Arizona's cannabis advertising laws, any direct, individualized communication or dialogue involving marijuana advertising must use an age verification method to confirm that the recipient is 21 years of age or older before engaging further. This age affirmation can be done through user confirmation, birth date disclosure, or other registration methods that verify the recipient’s age.

Additionally, it is unlawful for any individual or entity, other than a licensed marijuana establishment or dual licensee, to engage in specific activities related to marijuana or marijuana products unless explicitly authorized by the relevant chapter or departmental rules. These prohibited activities include facilitating the delivery of marijuana or marijuana products, soliciting or accepting orders for such products, or operating a platform that does so. It is also illegal to run a listing service related to the sale or delivery of marijuana or marijuana products. Arizona's cannabis advertising laws emphasize strict age verification and limit the entities authorized to engage in specific marijuana-related activities, ensuring compliance with regulatory standards.

  • Implement Age-Check Pop-Ups: Use pop-ups to confirm user age before displaying cannabis content, ensuring compliance while keeping interactions engaging.
  • Don't Use Minors in Imagery: To prevent misinterpretation and comply with age restrictions, avoid including anyone who appears to be under 21 in your ads or marketing materials.
  • Employ Age-Verified Interactive Features: Integrate age verification within interactive elements like quizzes or registration forms to make age confirmation part of the user experience.

Synopsis:

Any advertising under this chapter involving direct, individualized communication or dialogue shall use a method of age affirmation to verify that the recipient is twenty-one years of age or older before engaging in that communication or dialogue. For the purposes of this subsection, that method of age affirmation may include user confirmation, birth date disclosure or other similar registration methods.

It is unlawful for an individual or entity other than a marijuana establishment or dual licensee to do any of the following in a manner that is not authorized by this chapter or rules adopted by the department pursuant to this chapter:

1. Facilitate the delivery of marijuana or marijuana products.

2. Solicit or accept orders for marijuana or marijuana products or operate a platform that solicits or accepts orders for marijuana or marijuana products.

3. Operate a listing service related to the sale or delivery of marijuana or marijuana products.
