Louisiana State Advertising Regulations

Louisiana state legislators legalized medical marijuana in 2016, and its regulation falls under the Louisiana Department of Agriculture and Forestry. Although there are currently no specific cannabis advertising regulations in Louisiana, marijuana pharmacies face restrictions on how they can promote their products. They are prohibited from using public mediums such as newspapers, billboards, television, radio, internet, or social media to advertise.

Pharmacies can, however, use direct mail, brochures, or similar methods to reach Louisiana-licensed physicians, provided these communications are not accessible to the general public. All advertising aimed at physicians must avoid deceptive or misleading claims. While pharmacies can indicate that their products have been tested by approved laboratories, they cannot imply that their products are safe solely due to regulatory testing or oversight. This framework ensures that advertising remains truthful and appropriately targeted.

  • Targeted Communication: Use direct mail, brochures, and similar methods to target licensed professionals rather than the general public.
  • Truthful Claims: Ensure all statements about products are truthful and not misleading. Avoid any claims that suggest the products are safe solely due to regulation or testing.
  • No Deceptive Imagery: Avoid using imagery or language that could be seen as misleading or deceptive regarding the product’s effects or benefits.
  • Synopsis:

    (a) The marijuana pharmacy shall not advertise through any public medium, including but not limited to newspapers, billboards, television, radio, internet, social media, or any other means designed to market its products to the general public.

    (b) The marijuana pharmacy may market its products through direct mail, brochures, or other means to Louisiana-licensed physicians, but only when such advertising is directed solely to the practitioner and is not available to the general public.

    (c) Any advertisement permitted under Subsection (b) shall not:

    1. make any deceptive, false, or misleading assertions or statements regarding any product; or
    2. assert that its products are safe because they are regulated by LDAF or the board. The pharmacy may advertise that its products have been tested by an approved laboratory, but shall not assert that its products are safe because they are tested by an approved laboratory.
